WEEKLY LEGAL NUGGETS

THE RADIANT JUSTICE CHAMBERS, OBAFEMI AWOLOWO UNIVERSITY THE LEGENDARY AND BIZARRE RAPE CASE THAT WAS UNANIMOUSLY OVERTURNED   The case of R v Collins (1973) QB 100 is one of the most bizarre case that a criminal law student will find in his studies as the facts are particularly remarkable and the judgment that supported the “I thought I had just got lucky” view has become one of the most debated judgment of all time. In this case, the defendant Mr Collins, a 19 year old workman who had previously worked in the house of the victim, a 18 year old young woman went out for drinks and at about 2:00am went to the house drunk. The young woman was sleeping in bed naked and the window to her room was wide open. The room was not on the ground floor so Collins took a ladder and climbed over to the window seeing her laying in bed naked. He went down the ladder to undress leaving only his socks on. The victim having met her boyfriend a few hours earlier to that time thought t...

WEEKLY LEGAL NUGGETS

THE RADIANT JUSTICE CHAMBERS, OBAFEMI AWOLOWO UNIVERSITY WEEKLY LEGAL NUGGETS  THE GOLDEN RULE The Golden Rule means that where the literal meaning of words will lead to an absurd result, a court should adopt an interpretation that avoids the absurdity.  This rule is a modification of the  literal rule. It states that if the literal rule produces an absurdity, then the court should construe another, better-suited meaning to the words to avoid that absurd result.  The golden rule arises out of the fundamental principle that courts must interpret statute "according to the intent of them that made it". It usually avoids unjust or absurd results in sentencing. The main advantage of The Golden Rule is that through its application, drafting errors in statutes can be corrected immediately. The Golden Rule was formulated by Baron Parke in the case of Becke v Smith . The rule has merits and demerits. It enables the court to adopt a reasonable and sensible interpre...

WEEKLY LEGAL NUGGETS

THE RADIANT JUSTICE CHAMBERS, OBAFEMI AWOLOWO UNIVERSITY WEEKLY LEGAL NUGGETS  JUSTICE Justice means fairness, rightness, good and reasonable. The purpose of law, courts and the legal system is to do justice. The law aims to punish an offender in proportion to guilt and the injury done to a victim.  Justice is a tripartite affair i.e divided into three parts. In civil law, justice means; justice for the injured person, justice to the wrongdoer and justice for the state. In criminal law, it means; justice for the complainant, justice to the accused and justice for the state.  In upholding the cause of justice, Lawmakers should make laws that are just and reasonably justifiable. The courts should also do justice by ensuring that there is fair hearing of parties and correctly apply the laws without fear or favor. There are two main kinds of Justice:  1. Formal Justice: is the strict, mechanical and impartial application of the law by a judge without sympath...

This thought has probably crossed your mind when you see the annual women's day celebration mentioned on social media. After reading this, You might appreciate the International women's day a little better.  The theme of this year's International women's day campaign is: breaking the bias—this is about working towards an inclusive world free of stereotypes and discrimination.  Which got us thinking, what exactly led to the idea of breaking the bias? When were women prompted to rise and challenge a vastly patriarchal world? This article reflects the starting point, the journey, as a tribute to the extraordinary strides of women toward achieving gender parity.   Although the seed for celebrating international women's day was sown way before then, The first IWD was observed in 1911. Prior to this, 15,000 women marched in New York City, deman...

TOP 10 WEIRDEST LAWS IN COUNTRIES AROUND THE WORLD

THE RADIANT JUSTICE CHAMBERS, OBAFEMI AWOLOWO UNIVERSITY TOP 10 WEIRDEST LAWS IN COUNTRIES AROUND THE WORLD There exists certain laws in some countries that can only leave you raising your eyebrows in shock and curiosity as to what the lawmakers must have been thinking when they were making them. Though the laws may seem silly, ranging from what seems like an over-extension of personal principles to the the utterly ridiculous, they are deemed unlawful, and when flouted, can lead to arrest, or payment of fines. Laws like this make you understand why David Lynch, an American filmmaker once said “The whole world is wild at heart and weird on top”.  That  being said, these are some of the laws you should take note of to save you from  confusion, should you get arrested for the things the average Nigerian does every day without retribution, especially if you ever find yourself in any of these foreign countries. If you are part of team Japa like every average Nige...

The attack which was stated to have firstly occurred on the 24th day of February, 2022 has given rise to questions with the most asked one being “What does Russia want?”  Now, the attack otherwise known as a “special military operation” in the words of the Russian President, is also the biggest military mobilization in Europe since World War 2. It is reported to have stemmed from Russia’s aged desire under its current President Vladimir Putin to achieve the reintegration of the Soviet Union which had suffered a rapid collapse that resulted in its end in December 1991 as a then sovereign s...
