While a divorce ends a legally valid marriage, an annulment treats the marriage as if it never existed. Although the result is the same for both options – the parties are each free to marry again ¶ Generally, there is no exact period after the marriage by which an annulment must be sought. ¶ In Nigeria, nullity can be of a voidable marriage or a void marriage. Valid grounds for seeking an annulment are stated in Section 5 of the Matrimonial Causes Act. ¶ Lack of consent, duress, mental incapacity, prohibited degrees of consanguinity and affinity, and so forth are grounds for obtaining an annulment.
