WEEKLY LEGAL NUGGETS

THE RADIANT JUSTICE CHAMBERS, OBAFEMI AWOLOWO UNIVERSITY   Legal Nuggets⚖️   ANNULMENT  ¶ An Annulment is granted when a court finds that a marriage is invalid. While a divorce ends a legally valid marriage, an annulment treats the marriage as if it never existed. Although the result is the same for both options – the parties are each free to marry again ¶ Generally, there is no exact period after the marriage by which an annulment must be sought.  ¶ In Nigeria, nullity can be of a voidable marriage or a void marriage. Valid grounds for seeking an annulment are stated in Section 5 of the Matrimonial Causes Act. ¶ Lack of consent, duress, mental incapacity, prohibited degrees of consanguinity and affinity, and so forth are grounds for obtaining an annulment.       FROM THE OFFICE OF THE DIRECTOR OF LITIGATION AND RESEARCH.
